Terms of training

Article 1. Applicable terms and conditions
1.1 Various trainings, educations, courses and workshops (hereinafter referred to as 'Training Courses') can be purchased from Dutch Nail Cosmetics through the webshop of Dutch Nail Cosmetics, which can then be followed by the participant on location at Dutch Nail Cosmetics. On behalf of these Training Courses these 'Training Terms and Conditions' apply in addition to the already applicable general terms and conditions of Dutch Nail Cosmetics. These terms and conditions are provided upon purchase of the Training.

Article 2. Courses
2.1 The Courses offered by Dutch Nail Cosmetics can be found on the website, namely: https://dutchnailstore.nl/opleidingen/ (hereinafter: Website).

2.2 Dutch Nail Cosmetics is at all times entitled to change the offer of Courses.

2.3 Dutch Nail Cosmetics will make every effort to provide the Courses to the best of its ability and guarantees to fulfill the established agreements in a timely and complete manner subject to exceptions, all in accordance with laws and regulations.

2.4 Dutch Nail Cosmetics offers Training to both individuals and professionals acting in the conduct of a business or enterprise. Some Training Courses can only be followed by professionals. If this is the case, it is stated in the description of the Training. If a participant signs up for this Training, Dutch Nail Cosmetics may trust that participant is a professional.

2.5 Dutch Nail Cosmetics trusts that upon entering into this agreement participant provides all information and data - including any prior education - truthfully. If participant provides incorrect, inaccurate or insufficient information or data, Dutch Nail Cosmetics can in no way be held liable for any form of damage, or for the unsuccessful completion of the training or disappointing results. Should participant (have) caused damage, which can logically be the direct or indirect result of incorrect or incomplete information provided by Dutch Nail Cosmetics, Dutch Nail Cosmetics can hold participant liable for the full damage.

2.6 Participant may only follow the Training in his/her own capacity and is not entitled to transfer the Training, in whole or in part, to third parties, provided that he/she receives permission to do so from Dutch Nail Cosmetics.

2.7 Dutch Nail Cosmetics reserves the right to remove a participant from the salon during the training if the participant behaves improperly in any way towards (employees of) Dutch Nail Cosmetics or fellow participants or intentionally or culpably causes damage to (equipment in) the salon of Dutch Nail Cosmetics. In such case the participant is not entitled to a refund.

2.8 As indicated in the offer of the Courses on the Website, participant is required to bring a model to some Courses. If a model must be brought along, this is clearly stated in the offer/description of the Training on the Website. The model is necessary for applying the treatments that participant learns during the Training. Should participant not bring a model, Dutch Nail Cosmetics will make an effort to find another solution, but is not obliged to do so and bears no responsibility or liability. Should no model or other solution be found, participant may in some cases work on her own.

Article 3. Registration Training
3.1 Participant can purchase a Training through the webshop on the Website and register for a date made available there. Dutch Nail Cosmetics is at all times entitled to schedule the dates of the Courses at its own discretion.

3.2 The duration of the Course as well as the time of commencement and the time of completion of the Course varies for each Course. This information can be found in the description of the Course on the Website.

Article 4. Completion of Training
4.1 Upon successful completion of the Training, participant will receive a certificate. This certificate has no (legal) evidential value. The certificate only serves as proof of participation and successful completion of the Training.

4.2 Dutch Nail Cosmetics is entitled to freely assess whether participant completes the Training successfully and receives a certificate for that purpose. In this assessment Dutch Nail Cosmetics will pay attention, among other things, to the application of the pre-treatment, the general application/application of the treatment, and the result of the treatment/application.

4.3 Dutch Nail Cosmetics also monitors participant's interim progress during the Training. If Dutch Nail Cosmetics suspects at an early stage that participant will not successfully complete the Training within the training time, Dutch Nail Cosmetics will consult with participant on this matter. In such case Dutch Nail Cosmetics will advise participant to take an additional class or discontinue the Training. Should participant quit the Training early on the advice of Dutch Nail Cosmetics, Dutch Nail Cosmetics will refund the remaining Training fee to participant.  

Article 5. Payment and deposit
5.1 Different fees apply to the various Courses. The fees on the Website are stated exclusive of VAT.

5.2 A deposit of €100,00 ex VAT is required for each Course. The deposit is paid by participant when registering for the Course via the Website.

5.3 If participant cancels the Training and/or does not appear at the Training, the deposit will not be refunded to participant.

5.4 The remaining outstanding amount shall be paid by participant on the (first) day of the Training. Payment shall take place before the start of the Training at Dutch Nail Cosmetics in the salon.

5.5 For some Courses it is possible for participant to pay the remaining outstanding amount in parts. If and under what conditions this is possible will be stated on the Website. Payment in installments is subject to an additional cost of 10% of the Training Fee. For payment in parts for the 'Course Acrylic Gel Dutch Nail Cosmetics 8 days', the first installment is paid on day 1 of the Training and the second installment is paid on day 4 of the Training.

5.6 In order to take Courses it is necessary to use the products of Dutch Nail Cosmetics. Various packages are offered by Dutch Nail Cosmetics. Without products from Dutch Nail Cosmetics, participant cannot follow the Training. If it is necessary to purchase products from Dutch Nail Cosmetics, this is clearly indicated in the description of the Training on the Website.

5.7 If and when participant registers for a Course, she accepts an accepts the payment obligations that arise at that time and accepts that she must purchase required products from Dutch Nail Cosmetics for the purposes of the Course.  

Article 6. Cancellation, changes and non-appearance
6.1 If participant cancels the Training or changes the date, the deposit of
€100,00 ex VAT will not be refunded.

6.2 The date of the Training can be changed at the request of participant free of charge up to 20 days prior to the training day.

6.3 If participant purchases the Training in the capacity of a consumer, participant can cancel the agreement at all times without Dutch Nail Cosmetics being able to charge (cancellation/change) costs. However, in the event of early termination of the agreement by participant Dutch Nail Cosmetics will charge participant a reasonable fee depending on the costs already incurred by Dutch Nail Cosmetics for the purpose of the Training to be started. This compensation will include the cost of the training materials.

6.4 Should participant conclude the agreement for the purpose of the Training with Dutch Nail Cosmetics in the capacity of a business, participant cannot change and/or cancel the agreement early without Dutch Nail Cosmetics being able to charge participant for this - in addition to the costs already incurred by Dutch Nail Cosmetics - cancellation/change costs. These costs will depend on the time at which the agreement is changed/cancelled. If participant wishes to change or cancel the Training less than 20 days before the date of the Training, Dutch Nail Cosmetics is entitled to charge participant the following costs in accordance with the following schedule:

6.5 If participant fails to attend the Training without notice, Dutch Nail Cosmetics may also charge participant 50% of the training fee.

Article 7. Confidentiality
7.1 Participant shall keep confidential any information she receives (in whatever form) from Dutch Nail Cosmetics, except and insofar as Participant needs it for the performance of her work/what she was taught in the Training. Participant will take all possible measures to ensure that this clause is complied with. The same applies to all information (in whatever form) regarding Dutch Nail Cosmetics of which Participant knows or can reasonably suspect that it is secret or confidential, or of which she can expect that its dissemination may cause damage. The confidentiality obligation applies for the duration of the Training and for a period of 5 years thereafter.

Article 8. Intellectual Property
8.1 Dutch Nail Cosmetics retains all intellectual property rights, including but not limited to copyright, patent rights, trademark rights, drawing and model rights, etc. on all designs, drawings, writings, carriers with data or other information, quotations, images, sketches, models, models, etc., unless the parties unambiguously agree otherwise in writing.

8.2 Participant may not copy, show and/or make available or otherwise use any training materials obtained during the Training without the prior written and unambiguous consent of Dutch Nail Cosmetics.

8.3 Participant is prohibited from taking pictures of Dutch Nail Cosmetics' employees and customers and prices during the Training, unless otherwise specified by Dutch Nail Cosmetics.

Article 9. Penalty Provision
9.1 If Participant violates any provision of these Terms and Conditions, but specifically violates what is provided in Articles 6 and 7 of these Terms and Conditions, this penalty provision shall apply.

9.2 In case of violation of any provision participant shall fully indemnify Dutch Nail Cosmetics for all damages, costs, losses and liability resulting from the violation of the provision. In addition to indemnification, in case of violation of the provisions participant shall owe Dutch Nail Cosmetics an immediately due and payable penalty of € 500.00 per violation and increased by a penalty of € 150.00 per day(s) that the violation continues. Dutch Nail Cosmetics reserves the right to prove higher damages.

Article 10. Consequences of nullity or voidability
10.1 If any part of this agreement is void or voidable, this shall not affect the other provisions of this agreement. The void or voidable provision will in that case be replaced by a provision that comes closest to what the parties had in mind when concluding the agreement at that time.
